LAUREN P. UPTON

Lauren represents clients in diverse complex commercial disputes, through litigation and alternative dispute resolution, including business disputes, professional malpractice suits, insurance coverage disputes with an emphasis on design/build-related issues, non-competition/unfair competition claims, and real estate/land use disputes, as well as white collar criminal matters.  With over ten years’ experience representing contractors and engineers employed on Boston’s Central Artery/Tunnel Project, better known as “The Big Dig,” she has extensive experience handling matters involving owner/contractor disputes; design, workmanship, material, and differing site condition claims; construction accident/failure claims; and insurance coverage actions.  Lauren also represents architects, physicians, and other professionals in matters involving professional liability, as well as individuals in family and probate matters.

REPRESENTATIVE MATTERS

 

Prosecuted tens of millions of dollars in claims arising out of recurrent and persistent leaks in a multibillion dollar highway tunnel.

 

Successfully defended a general contractor in connection with a post-construction collapse of a suspended ceiling in an interstate highway tunnel.

 

Successfully defended a general contractor against claims arising out of its construction of more than one thousand slurry wall panels and charges that construction means and methods and alleged variances from contract specifications caused defects in the slurry wall panels.

 

Successfully prosecuted a multimillion dollar claim on behalf of a general contractor against a project owner, designers, insurers and a utility company in connection with the failure and replacement of a multimillion dollar multi-layer steam line.

 

Successfully prosecuted a multimillion dollar claim by an owner of a hotel/casino against two engineering firms relating to the defective design of the reinforced concrete structure of a hotel tower.

 

Successfully prosecuted a multimillion dollar claim of a general contractor against the owner arising out of the flooding of an immersed tube tunnel.

 

Successfully defended physician against claims of medical malpractice arising out of claims relating to prescribing practices.

 

Successfully defended an architectural firm against claims of negligence and implied warranties in subrogation action brought by plaintiff insurance company.

 

Successfully prosecuted multimillion dollar wrongful termination claim of architect against the owner of new high school construction, and successfully defended the architect in counterclaims by the owner for negligence.
